Acceptance of Terms
By booking, accessing, or using any services provided by Backroads Reservations (“Backroads,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service, as well as our Privacy Policy and all additional policies posted on our website. If you do not agree with these terms, please do not use our services. Backroads Reservations is operated by Texas Backroads, LLC, based in Bandera County, Texas.
Eligibility
Guests must be at least 21 years of age and legally able to enter into a binding agreement. By submitting a reservation, you represent that all information provided is true and accurate and that you have the authority to make the booking for yourself and all members of your party.
Booking and Payment Terms
A 50% deposit of the total reservation amount is required to confirm your booking. For one-night stays or reservations made within 14 days of arrival, full payment will be charged at the time of booking. We accept Visa, Mastercard, American Express, Discover, Zelle, and Venmo. Checks may be accepted for bookings over $1,000. Cash is not accepted. A 3% credit card surcharge applies to all card payments. Guests may avoid this fee by paying through Zelle or Venmo and noting their preferred payment method in the booking comments and we will not charge the card you provided in the form. The remaining balance is automatically charged within 7 days of arrival. If a payment method fails, the reservation may be canceled and the deposit forfeited. Upon receipt of payment, guests will receive a confirmation text message (emails are not sent) containing property details, access instructions, address, and driving directions. Guests are responsible for verifying all reservation details and must immediately report any discrepancies to reservations@backroadstexas.net or call (830) 850-9011.
Check-In, Check-Out, and Guest Conduct
Check-in begins at 3:00 PM, and check-out is by 11:00 AM unless approved in writing. Unauthorized late check-outs may result in a charge equal to half of one night’s stay. Registered guests are responsible for any damages or extra cleaning required after departure. If excessive cleaning is needed beyond normal use, a $25-per-hour cleaning fee may apply. Unauthorized guests, pets, or events are strictly prohibited and may result in immediate termination of the stay without refund. Smoking in any property is not allowed. Evidence of smoking inside any property will result in a $1,000 cleaning fee. Lost keys or gate remotes incur a $25 replacement fee. Lost or left-behind items may be mailed back for postage plus a $25 handling fee. Items not claimed within six weeks may be donated to charity.
Cancellations and Refunds
Cancellations made more than 14 days before arrival will incur a $100 cancellation fee. Cancellations made within 14 days of arrival will be charged for the first night’s stay and all applicable fees. Guests are responsible for the entire booking amount if a reservation is not canceled prior to the arrival date. There are no refunds for early departures or unused nights. Certain properties may have non-standard cancellation policies requiring up to 30 days’ notice; refer to the specific property’s webpage for details. Guests booking through third-party platforms such as Airbnb, Booking.com, VRBO or Google Travel are subject to that platform’s policies. If the Texas Department of Transportation declares roads impassable with no alternate route available, Backroads may consider alternate cancellation arrangements at its sole discretion.
Property Management and Limitations
All properties listed by Backroads Reservations are privately owned and operated. Backroads acts solely as a booking and marketing service and is not responsible for ongoing maintenance, property condition, or amenities. Backroads makes every effort to provide accurate descriptions and photos, but property details, furnishings, and amenities may change without notice. In rare circumstances, Backroads reserves the right to relocate guests to a comparable property if unforeseen issues arise, such as maintenance emergencies.
Liability Disclaimer
Guests acknowledge that they assume all risk of injury or damage while occupying or visiting a property booked through Backroads Reservations. Backroads, its owners, and its hosts are not liable for any accident, loss, or injury to guests, visitors, or personal property. All outdoor activities such as swimming, fishing, boating, hiking, or use of recreational equipment are undertaken at the guest’s own risk.
Privacy and Communications
By booking with Backroads Reservations, you consent to receive transactional messages related to your stay, including booking confirmations, payment reminders, check-in information, and updates. We may also occasionally contact guests by text message (SMS) or email to share special promotions, local travel updates, or new listings in the Hill Country area. You can opt out of promotional messages at any time by replying “STOP” to a text message or by contacting us at reservations@backroadstexas.net. Transactional messages related to your reservation cannot be opted out of.
Intellectual Property
All content, text, images, and designs on the Backroads Reservations website and Hill Country Travel App are owned by Texas Backroads, LLC and protected by copyright law. Use or reproduction without written consent is prohibited. Printing or saving for personal, non-commercial use only is permitted.
Modifications
Backroads Reservations reserves the right to modify or update these Terms of Service at any time. Continued use of our services or website following changes constitutes acceptance of the updated terms.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes shall be handled exclusively in the courts of Bandera County, Texas.
